 What Is Probate?
 Probate is the court-supervised legal process used to administer a deceased person's estate when assets were not transferred through a living trust or another non-probate method.

 For real estate, probate generally involves:

 Identifying estate assets
 Confirming legal authority to sell property
 Paying debts and valid creditor claims
 Obtaining court approval when required
 Distributing remaining assets to heirs or beneficiaries

 Not every inherited home must go through probate. Many California properties transfer through a revocable living trust, joint tenancy, transfer-on-death deed, or other estate planning tools. Determining whether probate is required is often the first step.

 Probate vs. Trust Sales
 Although they are often grouped together, probate sales and trust sales are very different. A probate sale is conducted under the authority of a court-appointed personal representative, such as an executor or administrator. Depending on the Independent Administration of Estates Act (IAEA) authority granted by the court, some sales require court confirmation while others do not. A trust sale is generally conducted by the successor trustee according to the terms of the trust document. Most trust sales do not require court involvement, making the transaction more similar to a traditional real estate sale while still carrying fiduciary responsibilities.
